DEFENDANT AWAITING TRIAL ON RAPE CHARGES UPSTATE, INDICTED IN BRONX FOR HAVING UNPROTECTED SEX WITH A MINOR GIRL WHILE KNOWING HE WAS INFECTED WITH HIV.

Bronx District Attorney Robert T. Johnson announced today the unsealing of an indictment against Nushawn Williams (a/k/a Shyteek Johnson). A grand jury has charged Nushawn Williams, 21, with two felonies – Reckless Endangerment in the 1st degree ("under circumstances evincing a depraved indifference to human life" engaging in conduct which created a grave risk of death to another person) and Attempted Assault in the 2nd degree. The defendant was also charged with Sexual Misconduct and Endangering the Welfare of a Child, both misdemeanors . The top felony charge of reckless endangerment carries of a maximum sentence of 2 to 7 years imprisonment.

It is alleged that during May of 1997, Nushawn Williams, while knowing he was infected with the HIV virus, had unprotected sexual intercourse with a minor. The defendant received counseling about his HIV status and the dangers thereof in September, 1996.

There is a continuing investigation into possible further charges against Williams based upon such conduct, involving the same or other victims.

District Attorney Johnson urges anyone who may have had sexual contact with Williams / Shyteek Johnson to call the Bronx District Attorney’s Office at 718 / 590-2195.

Nushawn Williams is presently serving a term of 1 to 3 years imprisonment for the sale of crack. He is also awaiting trial on rape charges in upstate Chautauqua County, New York.

Assistant District Attorney Astrid A. Borgstedt of the Domestic Violence / Sex Offense Bureau conducted the arraignment for Assistant District Attorney Maria T. Rivero who is prosecuting the case.
