THIRD TRIAL FOR BRONX MAN CHARGED IN FATAL SHOOTING FIVE YEARS AGO ENDS WITH A VERDICT OF GUILTY - MANSLAUGHTER CONVICTION FOR DEFENDANT WHO WAS 16-YEARS-OLD WHEN THE SHOOTING OCCURRED
Bronx District Attorney Robert T. Johnson announced today the manslaughter conviction of a 21-year-old man in the shooting death of a 16-year-old boy in February, 2005.
Quindell Francis was found guilty on one count of Manslaughter in the 1st degree and one count of Criminal Possession of a Weapon in the 2nd degree after two days of deliberations.
State Supreme Court Justice Dennis Boyle set sentencing for Wednesday, February 17, 2010 in Part T4. Francis is facing a maximum sentence of up to 25 years imprisonment on the manslaughter charge and up to 7 years imprisonment on the gun charge.
The jury acquitted Francis of the more serious charge of Murder in the 2nd degree in the death of Fernando Correa who was a star athlete and captain of the football team at Alfred E. Smith High School.
Two previous trials ended in mistrials, first when a jury was unable to reach a verdict and then during the second trial when defense counsel became ill and was unable to continue.
The fatal shooting occurred on February 1, 2005 behind a building at 352 Brinsmade Avenue, the Bronx. It was the culmination of a prior conflict between the deceased and a Bloods gang member.
Assistant District Attorney Christine Scaccia, Director of the Gang Prosecution Unit is prosecuting the case.
