ACTOR LILLO BRANCATO CONVICTED OF AN ATTEMPTED BURGLARY
WHICH LED TO THE DEATH OF AN OFF DUTY NEW YORK CITY POLICE
OFFICER

Bronx District Attorney Robert T. Johnson announced today that a 32-year-old actor was convicted of attempted burglary, in an incident which led to death of an off duty New York City Police Officer in December 2005.

Lillo Brancato, of Yonkers, New York, was found guilty on one count of Attempted Burglary in the 1st degree in an attempted break-in at the home of an acquaintance on Arnow Place in the Pelham Bay section of the Bronx. Police Officer Daniel Enchautegui, who was off duty when the attempted burglary occurred, was shot and killed while investigating the incident at his neighbor’s house. The jury acquitted Brancato of felony murder in Enchautegui’s death.

State Supreme Court Justice Martin Marcus set sentencing for January 9, 2008 in Part T- 13. Brancato is facing a maximum sentence of up to 15 years imprisonment.

District Attorney Johnson said: “Mr. Brancato clearly was a participant in a crime which led to the death of a courageous police officer. We intend to press for the maximum sentence that the law allows. We remain gratified that Steven Armento, Brancato’s accomplice who fired the actual shot, was convicted last month of Murder in the 1st degree and already has been sentenced to life imprisonment without the possibility of parole.”

The case was prosecuted by Senior Trial Assistant District Attorney Theresa Gottlieb and Assistant District Attorney April Cohen of the Trial Division.
