PHYSICIAN’S ASSISTANT FOUND GUILTY OF SCHEME TO DEFRAUD IN HOSPITAL TIME SHEET SCAM

Bronx District Attorney Robert T. Johnson announced today that a 49 year old Physician’s Assistant has been convicted of fraud in a scam involving the theft of tens ofthousands of dollars by improperly filing time sheets for working simultaneous shifts at two different hospitals.

Ann Landsman, of 3412 Avenue L, Brooklyn was found guilty on one count of Scheme to Defraud in the 1st degree, a Class E felony offense punishable by a maximum sentence of up to 4 years imprisonment. State Supreme Court Justice David Stadtmauer set sentencing for Wednesday, July 18, 2007 in Part T-19.

The jury deliberated for three full days before returning the guilty verdict in connection with time sheets that the defendant had submitted to Montefiore Hospital and its affiliate the Albert Einstein College of Medicine. The jury found that Landsman had engaged in a “systematic ongoing course of conduct with intent to defraud more than one person by false or
fraudulent pretenses, representations or promises.” The jury could not reach a verdict on a charge of Grand Larceny in the 3rd degree and acquitted the defendant of Grand Larceny in the 2nd degree.

The evidence showed that Landsman submitted fraudulent time sheets for working simultaneous shifts at Montefiore Hospital and the Albert Einstein College of Medicine from August 30, 1999 until September 29, 2003 which involved unearned income of more than $90,000. Auditors for the hospitals uncovered the scam after a doctor who was affiliated with both institutions came across one of the defendant’s time sheets. The doctor realized that she could not have been in two places at the same time. Hospital administrators contacted the Bronx District Attorney’s Office which conducted an investigation.

Mr. Johnson thanked Senior Trial Assistant District Attorney Jeffrey Glucksman and Assistant District Attorney Jessica Lupo of the Investigations Division, as well as Detective Steven Swindell of the Bronx DA’s Squad for their efforts that resulted in today’s conviction.
