24 MONTHS OF PROBATION FOR GIRL WHO GAVE BIRTH AT THIRTEEN AND PUSHED HER NEWBORN THROUGH A THIRD FLOOR WINDOW TO HIS DEATH IN JANUARY 2005

Bronx District Attorney Robert T. Johnson announced today that a young girl who pushed her newborn baby to his death through her third floor bedroom window has been placed on 24 months probation. The DA’s Office had recommended restrictive placement for the young girl who has been in custody in a New York State psychiatric facility since January 2005 when the crime occurred.

After more than four months of pre-disposition hearings and examinations, Family Court Judge Monica Drinane ruled that M.F. is to be placed on probation for a period of 24 months accompanied by intensive counseling, including individual therapy and family therapy. Other conditions of her probation require M.F. to cooperate with all referrals and appear in Family Court for monthly updates on her progress. Treatment services will be arranged and supervised through the Juvenile Justice Initiative of the NYC Agency For Children’s Services.

M.F. was adjudicated last December as ‘responsible’ for the depraved indifference murder of her infant son. The baby was killed on January, 14, 2005 a short time after he was born barely a month after his mother’s 13th birthday. M.F. admitted that she wrapped the newborn in a white T-shirt, opened the window in her bedroom, and pushed him under a window guard where he then fell into an alley. The murder occurred at the Morris Avenue apartment where the defendant lived with her family.

The case was prosecuted by Assistant District Attorney Kimberly Capers of the Domestic Violence Bureau.
