BRONX MAN IS SENTENCED TO TWENTY YEARS IMPRISONMENT ON ASSAULT CHARGES
Bronx District Attorney Robert T. Johnson announced today that 38 year-old Delroy Pitterson has been sentenced to a term of twenty years imprisonment for the June 2003 assault of his ex-girlfriend Eunice Deacon.
Pitterson, aka "Spaghetti", of 3034 Holland Avenue, was found guilty on May 10, 2005 of two counts of Assault in the 1st degree, and one count of Attempted Assault in the 1st degree, and one count each of Criminal possession of a weapon in the 2nd and 3rd degrees. He was acquitted on the charge of Attempted Murder in the 2nd degree.
Acting State Supreme Court Justice Judith Lieb sentenced Pitterson to five concurrent terms of twenty years imprisonment for each count of assault, a term of fifteen years imprisonment on the charge of attempted assault, and terms of fifteen and seven years imprisonment respectively on the weapons charges. Pitterson must also serve five years post release supervision.
The assault occurred around 7:00AM, on June 11, 2003, when Pitterson confronted Deacon as she entered the lobby of her building demanding to know where she had been. Unsatisfied with her answer, Pitterson pulled out a 9mm handgun and fired four shots at Deacon striking her once in the left hand before his gun jammed. Deacon ran out of the building screaming while Pitterson, who had jumped into his van, chased Deacon down the sidewalk and ran her over as she reached Burke Avenue. The defendant fled and turned himself in later that morning. Deacon suffered a fractured elbow, shoulder and ribs, a punctured lung and internal bleeding.
This case was prosecuted by Senior Trial Assistant district Attorney Bruce Birns of the Domestic Violence Bureau.
