THIRTEEN YEAR OLD GIRL CHARGED WITH MURDER IN THE DEATH OF HER NEWBORN CHILD - DEFENDANT TO BE PROSECUTED IN FAMILY COURT
Bronx District Attorney Robert T. Johnson announced today, after a thorough assessment of the facts and circumstances, that a charge of Murder in the 2nd degree has been filed against a thirteen year old girl who allegedly pushed her baby boy through a window minutes after giving birth. The alleged crime occurred several hours before dawn at the defendant’s home on January 14, 2005 approximately one month after her birthday.
M.F. was arraigned before Criminal Court Justice Ira Margulis who granted a motion by the People to prosecute the case in Family Court.
District Attorney Johnson said: “Our objective is to see that the defendant is punished for taking a life while at the same time, given her age, mental state, and circumstances of the birth, we believe that the Family Court procedure has all of the appropriate sentencing options.”
The maximum penalty upon conviction in Family Court is five years restrictive placement with the possibility of extending the period of confinement until the defendant turns twenty-one.
The case is being prosecuted in Family Court by Assistant District Attorney Kimberly Capers of the Child Abuse / Sex Offense Bureau.
