DOCTOR GUILTY OF SEXUAL MISCONDUCT IN CONNECTION WITH NON-CONSENSUAL ORAL SEX ACT PERFORMED ON A 49 YEAR OLD PATIENT
Bronx District Attorney Robert T. Johnson announced today the conviction of a 42 year old doctor on one count of Sexual Misconduct in connection with non-consensual sexual activity involving a 49 year old patient.
Brian Shaw, of Wilton, Connecticut, pled guilty to the single misdemeanor count before Acting State Supreme Court Justice Steven Barrett who set sentencing for February 2, 2005 in Part M60. Under terms of the plea agreement, Shaw will be sentenced to six years probation, required to register as a sex offender, and will waive all rights to appeal his conviction. Shaw has already surrendered his license to practice medicine to the New York State Department of Health.
Shaw, who was a physician at Throggs Neck Urgent Medical Care on Tremont Avenue, admitted that he performed oral sex on a patient without his consent, on December 9, 2003. The 49 year old victim, a truck driver, went to the medical facility at 3495 East Tremont Avenue seeking treatment for a rash on his chest and legs. The defendant admitted placing his mouth on the victim’s genitals during the examination.
