BRONX MAN IS SENTENCED TO A TERM OF UP TO LIFE IMPRISONMENT FOR THE 2002 MURDER OF A BRONX YOUTH

Bronx District Attorney Robert T. Johnson announced today that 23 year-old Shawn Green, has been sentenced to a term of up to life imprisonment for the shooting death of 16 year old Darryl Jawan Hayes, and the attempted murder of Duwayne Cousins, 16, in February 2002.

Green, of 1324 Oakley Street, was found guilty last October, of 1 count of Murder in the 2nd degree, and 1 count of Attempted Murder in the 2nd degree.

Acting State Supreme Court Justice Megan Tallmer, sentenced Green, a predicate felon, to consecutive terms of twenty-five years to life imprisonment on the charge of murder, and 15 years to life imprisonment on the charge of attempted murder. Green was also sentenced to a concurrent term of five years imprisonment for violating probation. Green must serve a minimum of forty years imprisonment before becoming eligible for parole.

The fatal shooting was a culmination of a daylong series of events on February 10, 2002. Green was on his way to work at a nearby Burger King, when he was hit by an egg thrown out of a window by the victims. When Hayes and Cousins came downstairs, Green confronted them and a fist fight ensued.

Angry because he lost the fight, Green went home, retrieved a gun and borrowed his mother's car. The defendant drove to the San Rafael Bodega, one of the victims' hangouts, at 3485 Boston Road, and waited inside.

As Hayes and Cousins entered the Bodega, Green shot Hayes three times in the chest and torso, then turned to Cousins and shot him once in the chest. The defendant fled, but was captured the next day at his home. Hayes died shortly after his arrival at Jacobi Medical Center. Cousins sustained permanent injuries to his right lung. A surveillance camera recorded the entire incident.
