BRONX MAN IS SENTENCED TO 45 YEARS IMPRISONMENT FOR THE 2002 SHOOTING DEATH OF A ANOTHER BRONX RESIDENT

Bronx District Attorney Robert T. Johnson announced today that a 27 year-old Bronx man has been sentenced on manslaughter and other related charges in the death of a 26 year-old Bronx resident.

Julio Alvarez, of 243 Third Avenue, was convicted last month of Manslaughter in the 1st degree in the shooting death of Danny Colon on April 16, 2002. Alvarez was also convicted of two counts of Assault in the 1st degree. The victims of the assault were Manny Colon, 17, and Aramis Fournier, 21.

State Supreme Court Justice Edward M. Davidowitz sentenced Alvarez to a term of 25 years imprisonment on the manslaughter charge, and 10 years imprisonment for each charge of assault, to be served consecutively, for a total of 45 years imprisonment.

During trial, the jury heard testimony that the fatal shooting was the result of an ongoing dispute between Alvarez and the deceased. Eyewitnesses testified that they saw Alvarez and an accomplice jump out of a car on Bryant Avenue, yell something at the deceased, who was walking with Manny Colon and Fournier. Alvarez then started shooting. Eyewitnesses further testified that Alvarez and his accomplice jumped back in the car and fled.

Colon later succumbed to multiple gun shot wounds at Lincoln Hospital. Fournier was shot once in the shoulder, and Manny Colon was shot once in each leg.

Assistant District Attorney Meredith Holtzman of the Gangs / Major Case Bureau prosecuted this case.
