JURY CONVICTS GUNMAN OF MANSLAUGHTER IN THE FATAL SHOOTING OF A LIVERY CAB DRIVER

Bronx District Attorney Robert T. Johnson announced today that a twenty four year-old Bronx man has been convicted of manslaughter in the fatal shooting of a thirty one year-old livery cab driver.

Arlin Abru Guzman, of 1240 Sherman Avenue, was found guilty of Manslaughter in the 2nd degree for killing Anelivda Brown on May 9, 2001.

Acting State Supreme Court Justice Ira R. Globerman set sentencing for Thursday, December 18, 2003 in Part T 24. Guzman is facing a maximum sentence of up to fifteen years imprisonment. Guzman was convicted after four days of deliberations following an eight week trial.

A second defendant, twenty four year-old Fermin Pena, pled guilty last February 28, 2003 to one count of Murder in the 2nd degree for his role in Brown’s death. Pena, who hired Guzman to kill the victim, was sentenced to a term of eighteen years to life imprisonment. The murdered woman was Pena’s ex-girlfriend.

The deadly ambush was set in motion when Pena telephoned the victim and asked for her assistance in jump starting his car because the battery was dead. When Brown arrived Pena and Guzman got into her cab and were driven to the intersection of Steenwick Street and Hollers Avenue, the location of Pena’s disabled car. Guzman then shot Brown once in the head after being promised $2,000 to commit the crime.

The case is being prosecuted by Assistant District Attorneys Astrid Borgstedt and Robert Diaz.
