BRONX MAN HAS BEEN SENTENCED TO THREE YEARS OF IMPRISONMENT FOR WEAPONS POSSESSION

Bronx District Attorney Robert T. Johnson announced today that a 30 year-old Bronx man has been sentenced to 3 years imprisonment on gun possession charges.

A jury last month found Robert Delgado, of 1615 Walton Avenue guilty of Criminal Possession of a Weapon in the 3rd degree. Acting State Supreme Court Justice Robert G. Seewald sentenced Delgado to a determinate term of 3 years imprisonment with 3 years post release supervision in light of the defendant’s prior criminal record which included a felony conviction more than 10 years ago.

Mr. Johnson said "This defendant’s imprisonment for a substantial period is most appropriate. Walking the streets with a loaded gun is a very serious crime that places everyone in danger. A handgun is an instrument of death and hopefully this sentence will send a strong message that even the mere possession of an unlicensed firearm will not be tolerated."

Four plain clothes New York City Police Officers observed Delgado shove a silver handgun into his waistband while entering a Bodega at 1580 Watson Avenue on June 29, 2001. The officers followed Delgado into the store where they recovered the weapon and apprehended the defendant.

Assistant District attorney Daniel P. DeFilippi of the Trial Division prosecuted this case.
